CABINET MOUNTAINS WATER DISTRICT At the August 14 Cabinet Mountains Water District board meeting, after many previous discussions with the district engineer, it was determined the Cabinet Mountains Water District is at full capacity to adequately service its current users. Based on information presented, the Cabinet Mountains Water District Board voted to temporarily suspend accepting any further applications for water service. Preliminary model analysis conducted by our engineer indicates that we are at system capacity. This parallels observations and measurements made by our maintenance personnel. In addition, peak usage during the last few summers has revealed areas that need improvement. Cabinet Mountains has been working hard to find and implement affordable solutions. At this point, we feel it is important to take the time to plan improvements carefully so that we can adequately serve those already on the system. WEICHAL dba Pacific Care and DONNA WEICHAL, husband and wife, as Grantors to BOUNDARY ABSTRACT COMPANY as Trustee, and IDAHO-NEVADA COMMUNITY DEVELOPMENT FINANCIAL INSTITUTION, INC. as Beneficiary, recorded on April 14, 2003, as Instrument No. 210122, records of Boundary County, Idaho. The Deed of Trust and the obligations secured thereby was assumed by Dennis M. Garrett dba Ace Elder Care 1 & 2 ("Successor Grantor") pursuant to an Assumption Agreement dated May 18, 2006, recorded on May 19, 2006 in Boundary County, Idaho as Instrument No. 226508. Foreclosure is made because of default in the payment and performance of obligations due and owing to Beneficiary by the Grantor which obligations are secured by the Deed of Trust. Said default is in the form of non-payment of amounts due and non-performance of obligations to the Beneficiary. Said breach has resulted in failure to pay the principal balance of $92,859.39, accrued interest of $9,165.43 through August 6, 2018, attorneys' fees and costs of $22,217.21 through July 27, 2018, late fees of $1,406.79 through August 6, 2018, forced placed insurance of $1,212.79 and a Trustee's Sale Guaranty for $605.00, for a total balance due of $127,466.61 as of August 6, 2018. After that date interest continues to accrue at $24.07 per day and attorneys' fees and costs and other costs and expenses continue to accrue as set forth in the next paragraph. That by reason of said default, all sums secured by the Deed of Trust are due and payable. As of August 6, 2018 with attorneys' fees through July 27, 2018, the aggregate amount secured by the Deed of Trust which is in default is the sum of $127,466.61, together with additional interest accruing at the rate of $24.07 per day, and accruing costs for attorneys' fees, payment of taxes, assessments, premiums for insurance, advances made by Beneficiary in accordance with the terms of the Deed of Trust, other expenses of foreclosure, and attorneys' fees and costs incurred in any litigation to foreclose Beneficiary's security interest in personal property owned by the Successor Grantor.
