A Bonners Ferry man accused of violating a law that does not allow more than one home on a 5-acre property was cleared of any wrong-doing on May 13 in court.

Property owner Jimmy Ball violated a Boundary County Ordinance by placing a guest home on his land on Moonshadow Road, according to court records.

Ball told the judge during the hearing that he had consulted count planning and zoning administrator Mike Weland numerous times to see if putting another house on his property would be allowed. Ball told the court Weland said it was no problem and even put it in writing.

Because of that, Ball’s criminal charges were dropped but the home might still have to be removed. County commissioners will hear the case.
