Not guilty pleas entered in burglary case

Two men from Bonners Ferry pleaded not guilty to felony   charges relating to a burglary at a Troy, Mont., business and vehicle arson.

Jason Eby, 34, and Kyle Cavanaugh, 22, were implicated in the June 23 incident after an officer allegedly spotted them and a third Bonners Ferry man, Josiah Mong, robbing the Booze ‘N Bait Shop.

Eby was arrested in the store and Cavanaugh and Mong, who were waiting in Eby’s pickup, allegedly fled the scene, set the truck on fire when it broke down on Highway 2 and left on foot. They were arrested shortly after as they walked east toward Libby.

An alarm went off alerting authorities after the men allegedly used the pickup to break the shop’s heavy door. Four of the store’s guns were piled up, bottles of liquor strewn about and Eby was arrested with three empty pistol magazines in his pocket, reportedly belonging to the store.

Eby was charged with burglary, theft and criminal mischief, all felonies.

Cavanaugh was charged with burglary by accountability, arson, tampering with evidence and criminal mischief, all felonies, as well as misdemeanor possession of marijuana.
