Combined Public Notice Finding of No Significant Impact on the Environment and Notice to Intent to Request for Release of Funds City of Moyie Springs, 3331 Roosevelt Road, Moyie Springs, ID 83845, (208) 267-5161 These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the City of Moyie Springs. Request for the Release of Funds On or about November 9, 2020, the City of Moyie Springs will submit a request to the Idaho Department of Commerce, State of Idaho, administering agency for the release of Idaho Community Development Block Grant (ICDBG) funds under Title I of the Housing and Community Development Act of 1974 (PL 93-383), as amended, to undertake the following project: Project Name: Wastewater System Improvements Project Program Activity/Project Description: The project scope of work will include influent screening, grit removal, Sequencing Batch Reactor (SBR) treatment, equalization, and more reliable chlorination as well as dechlorination. The WWTP discharge will be released through an outfall diffuser, which includes approximately 3,000 feet of new transmission line from the plant to the Kootenai River. Two new SBR's will be constructed as well as a small pump station. The project also includes solids handling, process and controls, and fencing. Location of Project: Moyie Springs, Boundary County, Idaho Estimated Cost of Project: $3,629,000 Finding of No Significant Impact The City of Moyie Springs has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at Moyie Springs City Hall, 3331 Roosevelt Road, Moyie Springs, ID 83845 where the ERR can be examined or copied Monday through Thursday from 9 AM to 5 PM and Fridays from 9 AM to 1 PM, and at Panhandle Area Council, 11100 N. Airport Dr., Hayden, ID 83835 where the ERR can be examined or copied weekdays from 8 AM to 5 PM. Public Comments Any individual, group, or agency disagreeing with this determination or wishing to comment on the project may submit written comment to the City of Moyie Springs for receiving and responding to comments. All comments received by November 9, 2020 will be considered by the City of Moyie Springs prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing. Release of Funds The City of Moyie Springs certifies to the Idaho Department of Commerce that Steve Economu, in his official capacity as Mayor, consents to accept the jurisdiction of the federal courts if an action is brought to enforce responsibilities in relation to environmental review process and that these responsibilities have been satisfied. The Idaho Department of Commerce's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows for the City of Moyie Springs to use ICDBG funds. Objections to State Release of Funds The Idaho Department of Commerce will accept objections to its release of funds and the City of Moyie Springs certification for a period of sixteen (16) days following the anticipated submission date or its receipt of the request (whichever is later) only if they are on one of the following bases: A. The certification was not executed by the certifying officer. B. The City has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; C. The City has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of the release of funds by the Idaho Department of Commerce. D. Another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.
