At the general election, voters will have the choice to approve or deny a proposed amendment that would allow the Idaho Legislature to convene itself in special session. This is called the State Joint Resolution 102.

The Legislature could only convene in a special session if 60% of the members in each house submit a petition to the President Pro Tempore of the Senate and the Speaker of the House of Representatives.

Currently, the Legislature cannot call a special session, rather that power resides with the executive branch through Governor Brad Little.

The proposed amendment specifies that the subject for the special session must be addressed in the petition and only those subjects could be considered and voted on during the special session. The amendment does not specify how long the special session may run.

The amendment would require the legislature to hold an organizational session in December following a general election with the purpose of preparing for the upcoming regular session.

This proposed amendment was passed through the house and the senate, but has mixed reviews with previous members of the executive, legislative and judicial branches.

Voters will also be posed an Idaho Advisory Question to either approve or disprove the state using budget surplus to refund $500 million to taxpayers, cut ongoing income taxes by more than $150 million and put more money in classrooms by increasing education and student funding to $410 million.
